OVERVIEW

This website is operated by AKIN STUDIO - JOHEELA, LLC (hereinafter “JOHEELA”), whose full legal name is provided in Article 18. On this site, the terms “we,” “us,” and “our” refer to JOHEELA. JOHEELA provides this website, including all information, tools, and services available on it, to you, the user, subject to your acceptance of all the terms, conditions, policies, and notices set forth herein.

By visiting this site and/or purchasing one of our products, you are engaging in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions of Sale,” “Terms and Conditions of Sale and Use,” “Terms”), including any additional terms, conditions, and policies referenced herein and/or accessible via hyperlink. These General Terms and Conditions of Sale and Use apply to all users of this website.

Please read these General Terms and Conditions of Sale and Use carefully before accessing or using our website. If you do not agree to these Terms, you must not use the services offered on this website.

The General Terms and Conditions of Sale applicable to an order are those in effect on the date of that order. JOHEELA may amend them for the future; any new version applies only to orders placed after it takes effect, unless otherwise required by mandatory law (see Article 19).

Our store is hosted by Shopify Inc. They provide us with the e-commerce platform that allows us to sell our products and services to you.

ARTICLE 1 – TERMS OF USE FOR OUR ONLINE STORE

By accepting these General Terms and Conditions of Sale and Use, you represent that you have reached the age of majority in your country, state, or province of residence, and that you have given us your consent to allow any minor in your care to use this website.

The use of our products for any illegal or unauthorized purpose is prohibited, and you must not, in connection with your use of the Service, violate the laws of your jurisdiction (including, but not limited to, copyright laws).

You must not transmit worms, viruses, or any other destructive code.

Any material breach of these Terms may result in the suspension of access to the Services under the conditions set forth in Article 16.

ARTICLE 2 – GENERAL TERMS AND CONDITIONS

We may deny a person access to our services for a legitimate reason (including fraud, prohibited use as described in Section 12, or seriously offensive or threatening behavior), without prejudice to the fulfillment of orders that have already been placed.

You understand that your content (excluding your credit card information) may be transmitted in unencrypted form, which may involve (a) transmission over various networks; and (b) modifications to comply with and adapt to the technical requirements for connecting networks or devices. Credit card information is always encrypted during transmission over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service or any use of the Service, or any access to the Service or contact on the website through which the Service is provided, without our express prior written permission.

The headings used in this agreement are included for your convenience and shall not limit or affect these Terms and Conditions.

ARTICLE 3 – ACCURACY, COMPLETENESS, AND CURRENCY OF INFORMATION

We strive to provide accurate, complete, and up-to-date information on this website. General content (tips, articles, guides) is provided for informational purposes only. However, JOHEELA is bound by the essential characteristics and price of the products listed on the product page at the time of order.

This site may contain certain historical information (archives, past news). By its very nature, this information is not up to date and is provided for informational purposes only.

ARTICLE 4 – CHANGES TO THE SERVICE AND PRICES

The prices applicable to an order are those displayed at the time the order is confirmed. JOHEELA may change its prices in the future; any price change does not apply to orders that have already been placed.

We may update, suspend, or discontinue all or part of the website (for example, for maintenance purposes). These changes do not affect orders that have already been placed, which will be fulfilled under the terms and conditions in effect on the date the order was placed.

ARTICLE 5 – PRODUCTS OR SERVICES (if applicable)

Certain products or services may be available exclusively online on our website. These products or services may be available in limited quantities. Returns and exchanges are handled in accordance with Section 22 and our Return Policy.

We have done our best to display the colors and images of our products as accurately as possible in our online store. However, we cannot guarantee that the colors displayed on your computer screen will be accurate.

Products are offered subject to available inventory and manufacturing capacity, and within the delivery areas indicated on the website. JOHEELA may set quantity limits per order or per customer, particularly to prevent resale, provided that such limits are indicated before the order is placed. Product descriptions and prices are subject to change in the future; the applicable specifications and price are those listed on the website at the time of the order. JOHEELA may discontinue a product without affecting orders that have already been placed.

The products are covered by statutory warranties and, where applicable, the JOHEELA commercial warranty described in Article 21.

ARTICLE 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

JOHEELA may refuse or cancel an order only for a legitimate reason, including: actual unavailability of the product, fraud or a serious suspicion of fraud supported by objective evidence (such as a payment issue), a manifest error as defined in Article 11, exceeding a quantity limit specified prior to the order, or the inability to deliver to the relevant territory. The customer will then be notified as soon as possible at the email address and/or phone number provided at the time of the order, and, if a payment has been processed, the customer will be refunded without undue delay.

You agree to provide current, complete, and accurate order and account information for all orders placed through our store. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you if necessary.

For more details, please see our Return Policy.

ARTICLE 7 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we have no oversight, control, or influence.

You acknowledge and agree that we provide access to such tools “as is” and “as available,” without any warranty, representation, or condition of any kind and without any endorsement. We shall have no liability arising from or related to the use of these optional third-party tools.

If you use the optional tools available on the site, you do so at your own risk and discretion, and you should review the terms under which these tools are provided by the relevant third-party provider(s).

In the future, we may also offer new services and/or features on our website (including new tools and resources). These new features and services will also be subject to these Terms and Conditions of Sale and Use.

ARTICLE 8 – THIRD-PARTY LINKS

Certain content, products, and services available through our Service may include material from third parties.

Links from third parties on this site may redirect you to third-party websites that are not affiliated with us. We are not obligated to review or evaluate the content or accuracy of these sites, and we do not guarantee or assume any responsibility for any content, website, product, service, or other item accessible on or from these third-party sites.

We are not responsible for any loss or damage related to the purchase or use of goods, services, resources, content, or any other transaction conducted in connection with these third-party websites. Please read the third parties’ policies and practices carefully and ensure that you understand them fully before engaging in any transaction. Complaints, claims, concerns, or questions regarding these third-party products must be directed to those third parties.

ARTICLE 9 – COMMENTS, SUGGESTIONS, AND OTHER PROPOSALS FROM USERS

If, at our request, you submit specific content (for example, to participate in contests), or if, without our request, you send creative ideas, suggestions, proposals, plans, or other materials—whether online, by email, by mail, or otherwise (collectively, “Comments”), you grant us the right, at any time and without restriction, to edit, copy, publish, distribute, translate, and otherwise use in any medium any comments you send to us. We are not and shall not be obligated (1) to maintain the confidentiality of any Comments; (2) to pay compensation to anyone for any Comments provided; or (3) to respond to any Comments.

We may, but are under no obligation to, monitor, modify, or remove content that we deem to be illegal, offensive, threatening, abusive, defamatory, pornographic, obscene, or otherwise objectionable, or that infringes any intellectual property rights or these General Terms and Conditions of Sale and Use.

You agree to post comments that do not infringe on the rights of third parties, including copyrights, trademarks, privacy, publicity, or other personal or proprietary rights. You also agree that your comments will not contain any illegal, defamatory, offensive, or obscene content, nor will they contain any computer viruses or other malware that could in any way affect the operation of the Service or any other associated website. You may not use a false email address, impersonate anyone, or attempt to mislead us and/or third parties as to the origin of your comments. You are solely responsible for all comments you post and their accuracy.

ARTICLE 10 – PERSONAL INFORMATION

The submission of your personal information on our online store is governed by our Privacy Policy.

ARTICLE 11 – ERRORS, INACCURACIES, AND OMISSIONS

From time to time, there may be information on our website or within the Service that contains typographical errors, inaccuracies, or omissions regarding product descriptions, prices, promotions, offers, shipping costs, delivery times, and availability. We may correct these at any time going forward.

Once an order has been placed, an error can only justify its cancellation in the event of a manifest error (for example, a ridiculously low price that bears no relation to the product’s actual value) or if it is impossible to fulfill the order. In all other cases, including when a benefit was granted in error by our customer service department and accepted in good faith by the customer, any correction to an order or commitment that has already been confirmed requires the customer’s consent. In the event of cancellation, the customer will be notified and fully reimbursed without undue delay.

ARTICLE 12 – PROHIBITED USES

In addition to the prohibitions set forth in the General Terms and Conditions of Sale and Use, you are prohibited from using the site or its content: (a) for illegal purposes; (b) to incite third parties to commit or participate in illegal acts; (c) to violate any regional ordinance or any international, federal, provincial, or state law, rule, or regulation; (d) to infringe upon or violate our intellectual property rights or those of third parties; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate against anyone based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or could be used in a manner that compromises the functionality or operation of the Service, any other associated or independent website, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, hijack a domain, extort information, or crawl, explore, or scan the web (or any other resource); (j) for obscene or immoral purposes; or (k) to breach or circumvent the security measures of our Service, any other website, or the Internet. We reserve the right to suspend your use of the Service for violating the prohibited uses, subject to the terms of Section 16.

ARTICLE 13 – JOHEELA'S LIABILITY

We do not guarantee that access to the site will be uninterrupted or error-free. We may temporarily suspend access, particularly for maintenance purposes.

JOHEELA shall not be held liable for any damages for which it is not responsible, including those resulting from the customer’s actions, unforeseeable and insurmountable acts by a third party not party to the contract, or force majeure.

No provision of these Terms and Conditions may have the effect of excluding or limiting the statutory warranties to which the consumer is entitled (statutory warranty of conformity and warranty against hidden defects), nor may it eliminate or reduce the consumer’s right to compensation in the event of a breach by JOHEELA of any of its obligations.

ARTICLE 14 – USER LIABILITY

The user is liable, under the terms of general law, for any damages caused by his or her negligence, particularly in the event that the site is used in violation of these Terms and Conditions.

ARTICLE 15 – SEVERABILITY

In the event that any provision of these General Terms and Conditions of Sale and Use is deemed illegal, void, or unenforceable, such provision shall nevertheless be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these General Terms and Conditions of Sale and Use; such severance shall not affect the validity and enforceability of the remaining provisions.

ARTICLE 16 – TERMINATION AND SUSPENSION

The obligations and responsibilities assumed by the parties prior to the termination date shall remain in effect after the termination of this agreement for all purposes.

You may stop using our Services at any time, including by requesting that we close your customer account.

In the event of a serious and proven breach of these Terms and Conditions (e.g., fraud, prohibited use as described in Section 12, or seriously offensive or threatening behavior), JOHEELA may suspend or close the customer’s account or deny access to the site, after notifying the user, except in cases of emergency. Such a measure shall not affect the fulfillment of orders already placed, nor the processing of related warranties, refunds, and claims.

ARTICLE 17 – ENTIRE AGREEMENT AND INTERPRETATION

Any failure on our part to exercise or enforce any right or provision of these General Terms and Conditions of Sale and Use shall not constitute a waiver of such right or provision.

These General Terms and Conditions of Sale and Use, as well as the policies to which they refer (return policy, shipping policy, privacy policy, warranty), govern your use of the Service and your orders.

In accordance with Article L. 211-1 of the Consumer Code, in case of doubt, these Terms and Conditions shall be interpreted in the manner most favorable to the consumer.

ARTICLE 18 – IDENTITY OF THE SELLER AND GOVERNING LAW

The website is operated by AKIN STUDIO - JOHEELA, a limited liability company (SARL), SIREN 853 789 527, intra-Community VAT number FR76853789527, with its registered office located at 1 bis rue Jean Luc, 78600 Maisons-Laffitte, France. Contact: contact@joheela-shop.com.

These Terms and Conditions are governed by French law, subject to any mandatory provisions that offer greater protection under the law of the consumer’s country of habitual residence, where the rules of private international law require their application.

ARTICLE 19 – CHANGES TO THE GENERAL TERMS AND CONDITIONS OF SALE AND USE

The current version of the General Terms and Conditions of Sale and Use is available at any time on this page; the date of the last update is shown at the top of the document.

The applicable Terms and Conditions are those in effect on the date of the order. JOHEELA may amend them in the future; any new version applies only to orders placed after it takes effect, unless otherwise required by law.

ARTICLE 20 – PRICES AND TAXES

The prices listed on the JOHEELA website are in euros (€), including all taxes. Shipping costs are displayed before the order is confirmed. JOHEELA charges the same listed price regardless of the delivery location.

Applicable taxes (VAT or local taxes) depend on the delivery location and, where applicable, on import conditions. For certain destinations, including certain overseas territories and countries outside the European Union, import duties or taxes may be collected by local authorities upon delivery; unless otherwise specified prior to placing the order, these are the customer’s responsibility.

Sales documents and invoices specify the tax treatment that actually applies to the transaction in question.

ARTICLE 21 – WARRANTIES

All products sold by JOHEELA are covered by the statutory warranty of conformity provided for in Articles L. 217-3 et seq. of the Consumer Code and the warranty against hidden defects provided for in Articles 1641 through 1649 of the Civil Code. To exercise these warranties, the customer should contact customer service at contact@joheela-shop.com.

JOHEELA also offers a 12-month commercial warranty starting from the date the pair is delivered. This warranty is a voluntary commitment that supplements statutory warranties; it neither replaces nor limits them. Its terms and conditions are detailed on the JOHEELA Commercial Warranty page.

The consumer has two years from the date of delivery of the goods to enforce the statutory warranty of conformity if a lack of conformity arises. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it arose.

When the contract for the sale of goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory warranty applies to such digital content or digital service throughout the entire period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service, and not the date on which it first appeared.

The statutory warranty of conformity requires the seller, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The statutory warranty of conformity entitles the consumer to have the item repaired or replaced within thirty days of making the request, at no cost and without significant inconvenience to the consumer.

If the product is repaired under the statutory warranty of conformity, the consumer is entitled to a six-month extension of the original warranty.

If the consumer requests that the item be repaired, but the seller insists on replacing it, the statutory warranty of conformity is renewed for a period of two years from the date the item is replaced.

The consumer may obtain a reduction in the purchase price while retaining the goods or terminate the contract by receiving a full refund upon return of the goods, if:
1° The seller refuses to repair or replace the goods;
2° The repair or replacement of the goods occurs after a period of thirty days;
3° The repair or replacement of the goods causes significant inconvenience to the consumer, particularly when the consumer is permanently responsible for the costs of returning or picking up the nonconforming goods, or if the consumer bears the costs of installing the repaired or replacement goods;
4° The nonconformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to rescind the contract when the lack of conformity is so serious that it justifies an immediate price reduction or rescission of the contract. In such cases, the consumer is not required to first request repair or replacement of the goods.

The consumer is not entitled to rescind the sale if the lack of conformity is minor.

Any period during which the item is out of service for repair or replacement suspends the remaining warranty period until the repaired or replaced item is delivered.

The rights mentioned above arise from the application of Articles L. 217-1 through L. 217-32 of the Consumer Code.

A seller who, in bad faith, obstructs the enforcement of the statutory warranty of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10 percent of the seller’s average annual revenue (Article L. 241-5 of the Consumer Code).

The consumer is also covered by the statutory warranty against hidden defects, pursuant to Articles 1641 through 1649 of the Civil Code, for a period of two years from the date the defect is discovered. This warranty entitles the consumer to a price reduction if the item is retained, or to a full refund upon return of the item.

ARTICLE 22 – RIGHT OF WITHDRAWAL

In accordance with Articles L. 221-18 et seq. of the Consumer Code, the consumer has fourteen (14) days from the date of receipt of the order to exercise the right of withdrawal, without having to provide a reason for the decision or incur any costs other than those indicated below. JOHEELA voluntarily grants an extended period of thirty (30) days from the date of delivery, subject to the terms of its Return Policy.

To exercise this right, the customer must notify JOHEELA of their decision before the deadline expires, using the online withdrawal form available on the Returns, Exchanges, and Refunds page, or by any other unambiguous statement sent to contact@joheela-shop.com or by mail to the address specified in Article 18. The customer may use the sample form below, though this is not required.

The customer must return the product no later than fourteen (14) days after notifying us of their decision. The customer is responsible for the direct costs of return shipping. The customer may be held liable for any depreciation of the product resulting from handling other than that necessary to determine its nature, characteristics, and proper functioning.

JOHEELA will refund the full amount paid, including the initial shipping costs (up to the cost of the least expensive standard shipping option offered), no later than fourteen (14) days from the date it is notified of the decision to cancel. This refund may be deferred until the product is received or until the customer has provided proof of shipment, whichever occurs first. The refund will be issued using the same payment method used for the order, unless the customer expressly agrees to another method.

In accordance with Article L. 221-28, paragraph 3, of the Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or that are clearly personalized. The products in question are identified as such on their product pages before the order is placed.

Sample withdrawal form (to be completed and returned only if you wish to withdraw):

If an amicable resolution cannot be reached, the consumer may, free of charge, refer the matter to the consumer ombudsman with jurisdiction over JOHEELA within one year of filing a written complaint: ANM Conso – Consumer Mediation, 2 rue de Colmar, 94300 Vincennes – www.anm-conso.com. The consumer remains free to bring the matter before the competent courts.
